DELIVERY & RECEIPT OF THESE TERMS AND CONDITIONS ESTABLISHES ACCEPTANCE BY FINANCIALLY RESPONSIBLE PARTY (RENTER).
RESERVATIONS The Renter / Guest must be 25 years of age or older unless accompanied by an adult guardian or parent or approved by the Landlord or Landlord’s Representative. If the accompanying guardian is not present, Guest may be evicted without refund.
No refunds are permitted due to early departure.
Terms include those in this Agreement (“Agreement”); any online agreement or terms; confirmations; directions and instructions (check-in, checkout); house rules, house signs, and similar documents; any condominium or homeowners’ association rules and applications (including required approvals); and any options, optional agreements, and waivers. Should any conflicts arise, the terms of this Agreement control.
PROPERTY (“PROPERTY”)
As described online.
PAYMENTS & CHARGES
Payments and charges are in accordance with any online agreement and the terms below.
Payment Method. Major debit/credit cards are accepted.
DAMAGES TO PROPERTY If, upon arrival, Renter notices any existing damages such as, but not limited to, those listed below, please contact Landlord or Landlord’s Representative immediately. RE/MAX at the Sea has arranged for Accidental Damage Waiver Policy which is available to Renter. If not purchased we reserve the right to charge for damages caused by the Renters or their Guests to the Property or if purchase that are over and above the waiver payment. Landlord or Landlord’s Representative will send an Invoice to the Renter detailing the damages and charges within 24 hours of departure. Your credit card on file may be charged for damages if, but not limited to:
- All debris, rubbish inside and outside of Unit is not discarded and removed from property.
- All dishes are not washed and left in the drying rack prior to departure.
- All charges accrued during the stay are not paid prior to departure.
- Early check-in or late check-out not approved by Landlord.
- The Renter is evicted by the Landlord or Landlord’s Representatives, including but not limited to local law enforcement.
- Any evidence of smoking inside of the Unit is discovered.
- Any property belonging to the Landlord is missing or damaged.
- Landlord or Landlord’s Representatives have made prior arrangements with Renter to access the Unit and are denied or are not able to access the Unit because of Renter’s failure to make the Unit accessible.
- Loud music, loud talking, or excessive noise is reported by other Guests of the Unit after 9:00 p.m.
PARKING RULES Renter may not permit more than number of vehicles including but not limited to automobiles, trucks, trailers, motorcycles, jet skis and boats as allowed in reservation. Additional vehicles may be approved by the Landlord or Landlord’s Representatives. Renter may not park or permit any person to park any vehicles on grass.
SAFETY AND CHILDREN Safety and security is the sole responsibility of the Renter. Property owner(s), Landlord or Landlord’s Representative assume no responsibility or liability for the safety or security of the guests, or for injury caused by the criminal acts of other persons. In case of danger or potential damage to persons or property, call 911. The properties have not have been made “child-safe,” as various cleaning agents, knives, and other normal household items may be within the reach of small children. Please be aware and cautious with your little ones.
NO DAILY MAID SERVICE
OTHER RULES
- Fireworks and open flames are prohibited.
- Glitter and confetti are prohibited.
- Outdoor grilling, marshmallow roasting and fires are allowed only in designated pits unless a Burn Ban is in effect.
- Noise must be controlled (loud music, loud talking or excessive noise)of the Unit from 9:00 p.m. to 9 a.m.
- Trespassing on neighboring properties, it is strictly forbidden. Please be respectful of the neighboring Units and guests as well as neighbors and their property.
- Air conditioning should not be set lower than 70 degrees to avoid freezing the units, nor set above 78 degrees on the heat setting to avoid overheating the unit.
- No outdoor temporary structures are allowed on the Property such as, but not limited to, tents and awnings without approval from Landlord or Landlord’s Representative.
Payment Terms. As described online. Fifty percent (50%) of the total amount is due upon reservation to secure the booking. The balance is due 30 days prior to the start of the rental period.
Travel Insurance. We encourage guests to consider travel insurance for peace of mind regarding cancellations or unexpected personal injury.
Credit Card Documentation & Authorization. The primary Guest must submit a copy of their driver’s license or government-issued ID to complete the reservation. The Guest authorizes RE/MAX at the Sea to charge their credit card(s) for any additional charges or penalties incurred under this Agreement.
Chargebacks & Refunds. The Guest waives any right to dispute a credit/debit card charge or to request a refund through the payment platform and agrees instead to use the alternative grievance, litigation, and arbitration policies outlined in this Agreement.
GRIEVANCE POLICY
Please contact the RE/MAX at the Sea with any concerns or questions. We guarantee to do all we reasonably can within policy to accommodate you. Claims are waived unless reported within 24 hours of discovery, and a reasonable time to cure must be allowed.
ANIMALS
Pet Policy. Each home has its own pet policy. Kindly refer to the individual policy for the Property you are booking.
PETS We do not allow pets on our properties that state no pets allowed or not pet friendly. Renter may not permit, even temporarily, any pet on the Property or in Unit including but not limited to any mammal, reptile, bird, fish, rodent, or insect unless approved by the Landlord or Landlord’s Representative. If we find evidence of unauthorized pets, the Renter may be charged and/or evicted.
Emotional Support Animals (ESAs). ESAs require a written request at the time of reservation and official documentation (from a licensed doctor or government agency) of a diagnosed disability, unless the need is readily apparent. If documentation is not provided, the standard pet policy applies.
Service Animals. Service Animals are defined by §413.08, Fla. Stat. (2024). Animals in training are included but must be disclosed at the time of reservation. No documentation is required; however, any person who knowingly misrepresents themselves as being qualified to use an ESA or Service Animal commits a second-degree misdemeanor, punishable pursuant to §§775.082–083, Fla. Stat. (2024).
Removal. RE/MAX at the Sea reserves the right to remove any animal for inappropriate behavior.
Commercial Use. Commercial use of the Property is prohibited
TENANT DEFAULT. In the event that the tenant wishes to cancel the fully signed lease, He /She shall make such a request in writing to RE /MAX at the Sea . The lease shall be terminated only after another tenant is secured or permission from the owner is otherwise granted. In the event of cancellation by tenant, payments will be refunded only when the properties re -rented at no loss to the owner and 11% of such refund shall be deducted as a fee for the agency re-rental services. Owner may terminate lease upon tenants’ failure to make any rent payments when due.
Vacation Rental Damage Protection: As part of your reservation, you may purchase Vacation Rental Damage Protection to cover accidental damage to the rental unit during your stay. Damage must be disclosed to management prior to checkout. If purchased, the Plan will pay a maximum benefit of $ 1,500 or $3,000 based on the plan selected. Any damage that exceeds $ 1,500 or $3,000 or is not covered under the Plan is agreed to be paid by you. Vacation Rental Damage Protection can be purchased up to 10 days prior to check in. Certain terms and conditions apply.
If tenant does not wish to participate, the tenant MUST notify Rental Agent prior to signing this lease. Tenant shall than be required to pay the security deposit posted and required by the landlord. If tenant participates, landlord agrees to waive the security deposit. If a security deposit is taken for any lease under 125 days it shall be held by the broker in writing with in thirty (30) days of lease expiration, in the event the owner claims all or a portion of the security deposit pursuant to the terms of this lease, Broker shall have 30 days to notify the tenant of any claim. Absent any such notice from the owner, Broker shall be authorized to return such deposit. In the event of a dispute between the owner and tenant, the broker shall not release any disputed funds without consent from both parties.
REQUESTS TO CANCEL AND Red Sky TRAVEL INSURANCE: Guest Protect Plan can be purchased thru Red Sky Travel Insurance anytime prior to or within 24 hours of Final Trip Payment. If you purchase this plan and are not satisfied within 10 days of receipt, contact the rental office to indicate your desire to cancel. If you haven’t already left on your trip or filed a claim, you will receive a complete refund of your plan cost. Requests to cancel must be in writing. This will authorize the re -renting of the property subject to the acceptance of the owner. Rental money shall be retained by the owner until the property is re -rented at the full price at which time a full refund will be authorized. If the property is not rented or only a reduced price, the difference shall be due from the tenant and /or deducted from moneys received. If, however, the property is destroyed by fire or other natural events so as not to be fit for occupancy, or is restricted for occupancy by a governmental mandated evacuation order, owner shall provide a full refund of rent.
